According to official letter No. 4296/LĐTBXH-LĐTL:

For signing labor contracts, when definite labor contracts expire but employees still continue to work, during 30 days from the expired date, both sides must sign a new labor contract. In case, both sides sign a new one and is definite, it is only signed one time, then if employees still continue to work, the indefinite labor contracts must be signed.

In case, employees (including retirement) work enough 12 months or more with a signing contract, when terminating labor contracts as regulations, employers are responsible for paying severance as regulations. Employers are responsible for paying severance to employees for the time they are off from maternity.
